§ 18-4. Installation of traffic calming techniques, other than speed tables.

  • (a)

    Initiation of process. A neighborhood group may initiate the review and consideration of the installation of traffic calming techniques on a local street in a residential neighborhood by request through the community development department.

    (1)

    The request shall contain the following:

    a.

    Identification of the problems experienced in the residential neighborhood which have caused the neighborhood group to propose traffic calming techniques on a local street.

    b.

    Identification of the segments of local street(s) proposed for installation of traffic calming techniques.

    (2)

    The request should be sent to:

    (3)

    Following receipt of a request the community development department will convene a meeting of the neighborhood traffic committee. The committee will determine the boundaries of the area affected by the proposed installation of traffic calming technique(s) based on the local roadway system and other planning and engineering considerations.

    (4)

    The neighborhood traffic committee will then provide to the neighborhood group:

    A blank application form

    A subdivision map of the affected area

    A City of Oakland Park Traffic Calming Manual

    Information on accepted design standards regarding placement of traffic calming measures

    A list of property owners within the affected area, as determined by folio numbers, from the current Broward County tax roll

    (b)

    Application process.

    (1)

    Using the subdivision map provided by the city, the neighborhood group will indicate the area(s) or location(s) proposed for installation of traffic calming technique(s).

    (2)

    Using the list of property owners provided by the city, the neighborhood group will solicit signatures on a petition indicating support for the installation of traffic calming technique(s) at the locations indicated on the subdivision map.

    (3)

    Each folio number listed on the tax roll within the identified area shall count as one (1) vote and only one (1) property owner per folio number will be permitted to sign the application.

    (4)

    The neighborhood group shall return the completed application form, with signatures from a minimum of sixty-seven (67) percent of the property owners in favor of the installation of traffic calming technique(s), to the community development department.

    (c)

    Approval process.

    (1)

    Upon receipt of a valid application submitted by a neighborhood group, the neighborhood traffic committee shall prepare a written recommendation to the city manager regarding the proposed installation of traffic calming techniques. The evaluation of the application and the report shall include the following:

    a.

    Verification of the names on the signed petitions.

    b.

    Recommendations from those city departments whose functions and activities may be impacted by the proposed installation of traffic calming technique(s), and from Broward County traffic engineering.

    c.

    The results of a traffic speed and volume study conducted in the affected area over a span of thirty (30) days.

    d.

    A determination whether there exists a violation of the function of local streets within the residential neighborhood.

    e.

    Identification of possible alternative actions which would alleviate the problems identified in the application.

    f.

    An estimated cost of completing the proposed installation of traffic calming technique(s).

    (2)

    An advertised public hearing before city commission on the proposed installation of traffic calming technique(s) shall be scheduled. Notification shall be provided to any adjacent local government that also has jurisdiction over the local street if the traffic calming technique(s) are proposed to be adjacent to the location where jurisdiction for the local street changes. Such public hearing shall be held after 5:00 p.m. on a weekday. Based on a review of the report prepared by the neighborhood traffic committee and the input of the public at such hearing, the city commission may:

    a.

    Approve traffic calming techniques as requested by the neighborhood group;.

    b.

    Amend the request;

    c.

    Disapprove the proposed installation of traffic calming techniques.

    (d)

    Public notice. Notice of public hearings regarding proposed installation of traffic calming technique(s) shall be given by first class mail to owners of property within the affected area as determined by the neighborhood traffic committee. For purposes of notification, the property owners and their addresses shall be considered to be the names and addresses shown on the tax records maintained by the Broward County property appraiser for the City of Oakland Park. The notice shall be mailed at least ten (10) days before the date of the public hearing. A public notice regarding the public hearing shall be placed in a newspaper of general circulation at least ten (10) days prior to the public hearing and shall contain the day, time and place of the public hearing and a brief description of the proposed street modification to be heard.

    (e)

    Recovery of costs.

    (1)

    All costs associated with the notification of property owners and the advertising of public hearings relative to the installation of traffic calming techniques shall be borne by the applicants. Installation of traffic calming technique(s) shall not occur until such time as payment is tendered.

    (2)

    All costs associated with the speed and volume study and the installation of traffic calming shall be borne by the applicants. Installation shall not occur until such time as payment is tendered.

    (3)

    Such costs are to be submitted as one (1) sum to the city after city commission approval and prior to any work associated with the installation.
