§ 5-35. Appeal.

  • Any person or persons, jointly or severally aggrieved by a decision of the unsafe structures board may present to the Circuit Court of Broward County an action for declaratory decree or equitable relief, a complaint or petition duly verified in the manner provided by law and setting forth that such decision is illegal, in whole or in part, specifying the grounds of the legality, providing the same is filed within thirty (30) days after such decision.

    Costs shall not be allowed against the board unless it shall appear to the court that it acted with gross negligence, or in bad faith, or with malice in making the decision appealed from.
