§ 7-6. Permit to engage in waste tire collection business.

  • (a)

    Definition. For the purpose of this section, "waste tire collection business" shall be defined as a business which mechanically or manually collects waste tires from any individual or other business for disposal at any site licensed by the State of Florida Department of Environmental Regulation.

    (b)

    Any person desiring to provide waste tire collection services within the city shall apply to the sanitation department for a permit.

    (c)

    In order for the sanitation department to issue a permit, the following information shall be provided by the applicant:

    (1)

    Name and address of the applicant;

    (2)

    Trade name under which the applicant proposes to do business;

    (3)

    Nature and character of the service the applicant proposes to render;

    (4)

    The experience the applicant has in rendering such service;

    (5)

    Any other information which the chief sanitation official may require;

    (6)

    A copy of the State of Florida Department of Environmental Regulation permit.

    (d)

    A permit issued under this section shall be valid for one (1) year and may be cancelled by the sanitation department for inadequate precaution in collection or disposal of waste tires. Inadequate precaution in collection or disposal of waste tires may be evidenced by the littering of public or private property or by interfering with or hindering of city garbage and water collection services. If the sanitation department determines that there has been inadequate precaution, a notice of intent to revoke the waste tire permit shall be issued. Said permit shall be deemed revoked thirty (30) days after issuance of the notice unless withdrawn by the sanitation department. After receipt of said notice, the holder of the permit may seek review of the revocation with the sanitation department.

    (e)

    Upon providing the necessary information, the applicant shall be entitled to a permit for a period of one (1) year, provided, however, that the applicant shall pay the city an annual fee of five hundred dollars ($500.00). All monies collected shall be transferred to the refuse fund budget.

    (f)

    The permit for waste tire collection services may be cancelled as set forth in subsection (d) or for any other due cause as determined by the sanitation department.
