§ 8-10. Curfew for minors.

  • (a)

    It shall be unlawful for any person under eighteen (18) years of age to loiter, wander, stroll, loaf or play in or upon the streets, roads, avenues, alleys, parks or other public places in the city, or to loaf on any beach or in any vehicle placed or parked thereon between the hours of 11:30 p.m. and daylight of-the following day, unless accompanied by the parent, guardian or other adult person having the care, custody or control of such minor.

    (b)

    Whenever any police or other officer charged with the duty of enforcing the laws of the state or the ordinances of the city discovers a violation of this section, or has his attention called to the fact that any minor is violating any of the provisions of this section, such officer shall make an immediate investigation of the alleged violation. If the investigation reveals that this section is being violated by any minor, the police officer shall take such minor into custody and cause such minor to be taken or delivered to his home or place of residence. Any minor violating this section and any person accompanying such minor while violating this section shall be taken before the court having jurisdiction to be dealt with in accordance with the law.

    (c)

    It shall be unlawful for the parent, guardian or any person having the care, custody or control of any person under eighteen (18) years of age to permit such minor to violate any of the provisions of this section. Any parent or guardian of such person violating this section shall be punished as provided by section 1-8 of this Code.
